In the past few years, we have noticed that the GC/Contractors' constraints are communicated verbally in meetings, liberal email communications, minutes, presentation of review meetings, etc. While some are rightfully captured and addressed, some are left unattended until the same becomes critical. The reasons for the above being, a liberal mode of communication and no formal protocol to create awareness and address them.
The proposed mechanism is to capture such constraints formally and resolve them promptly. Constraints here means project-related constraints/troublesome issues, which may affect the Project Cost, Schedules, Scope and Quality, but beyond the Contractor's scope. Within the Contractor's scope, their team needs to be addressed internally, without escalating to the Client, through their internal process.
The General Contractor (GC) or Contractor or Vendor shall notify any issues /constraints that they are facing concerning the Contract/Project/Works, may be communicated as per the PROTOCOL mentioned in this document for early response/resolving of issues.
Notifications given to the Client by the GC/Contractor under this process shall no way lessen or relieve the Contractor from their obligations, liabilities, roles and responsibilities under the Contract. They may still communicate formally for those issues that require formal communication/notices contractually.
This mechanism of reporting by the Contractor is exclusively for any constraints/troublesome issues that may affect the Project if not attended within a time frame and outside the sphere of influence of the Contractor. Day to day communication between the Contractor and the Client shall continue for all operational aspects as before and as per Contract unless the same requires resolution through client intervention. The Contractor is expected to take all necessary actions as needed to be taken as per the general practices. This mechanism is to formalise and identify issues that require Client intervention for resolution. Notifying such matters through this protocol does not relieve the Contractor for all the actions and efforts they are supposed to take as per the accepted practices and contractual requirements.
In that sense, it is a tool for resolving issues and not a substitution of any of the existing processes or contractual requirements. This arrangement will not substitute the day to day communication between the Client and the Contractor. This arrangement is exclusively meant for smooth handling matters by the Client as it helps the Contractor achieve their goal of project delivery in cost and time with absolute quality and safety.
